Letzt genanntes ist ein unumstrittenes journalistisches Qualitätsmerkmal, um eine möglichst objektive und ausgewogene Berichterstattung zu ermöglichen. Nur sorgfältigste Recherche und saubere journalistische Arbeit können die Gefahr eines Gegendarstellungsanspruchs auf ein minimal senken, wenn auch nicht immer gänzlich ausräumen. Schwierig wird dies vor allem, wenn ein Betroffener von vorneherein keine Stellung zu Vorwürfen nimmt, die seine individual betreffen.
Die Wurzeln der Gegendarstellungen beruhen auf dem französischen Entwurf des „droit de résponse“, der 1831 in Deutschland übernommen wurde und 1874 in den Reichspressegesetzen verankert wurde (Kapitel 2.1). Kennzeichnend für die deutsche Rechtsprechung ist seit dem letztgenannten Zeitpunkt, dass der Anspruch sich ausschließlich gegen Tatsachenbehauptungen richtet.
Während die Reichspressegesetze Bundesländer übergreifend galten, ist die mediale Gesetzgebung heutzutage Ländersache. Allerdings kann sich der Anspruch auf das durch das Grundgesetz gesicherte allgemeine Persönlichkeitsrecht berufen (Kapitel 2.2). Indes kann es durchaus passieren, dass unterschiedliche Landesgerichte die Rechtslage tendenziell unterschiedlich auslegen. Es heißt, einige seien Medien freundlicher, andere Medien feindlicher.
